Is Berlin about to expropriate its big landlords? Not yet. Three parties have a plan, but no coalition, no law and no court ruling
O que precisa de saber
The Left won the Berlin election on 20 September with 25.7 percent. With the Greens and the SPD it would have 91 of 153 seats.Confirmed1021511
Their joint paper, agreed on 17 October, plans to use Article 15 of the Basic Law for private landlords with 10,000 or more flats in Berlin. Each would keep 10,000. Cooperatives and homes built since 2021 are exempt.Confirmed45367
Compensation is capped at 16 billion euros. The bill is due in mid-2028 and the transfer takes effect one year after the law is promulgated.Confirmed4623
SPD and Greens voted on 19 October to open coalition talks. The Left decides on 31 October.Confirmed189
Vonovia says the plan is unconstitutional. No court has ever ruled on Article 15, which has never been used.ConfirmedUnconfirmed212131415316
The honest short version: a left-wing Berlin government is likely but not formed, socialisation is its plan but not law, and the first flat could change hands in 2029 at the earliest, if the courts allow it.

Planned: Left party conference decides on coalition talks; financing concept in 2027; bill in mid-2028; transfer a year after promulgation.Confirmed189463
Who is involved
- Elif Eralp leads the Left, the winner of the election, and could become the party's first governing mayor of Berlin. She made socialisation a central promise and says about 160,000 flats would be affected.ConfirmedFalse52729930
- Steffen Krach leads the SPD, which got its worst Berlin result ever. He had spoken out against socialisation and now calls the compromise defensible; his party executive backs talks. Werner Graf and Bettina Jarasch lead the Greens in parliament.Confirmed1021112489
- Vonovia is the largest private landlord in the city and the most exposed company. It says the plan would fail in court.Confirmed21257
- The federal CDU/CSU and SPD coalition has announced a federal law to block state socialisation of rental housing, but has not drafted it.Confirmed21222
- Friedrich Merz and Berlin CDU leader Stefan Evers oppose any government with the Left. Evers still offers a CDU, Greens and SPD coalition, which would have only a two-seat majority.Confirmed2551110
- Vanessa Emde, a Left MP from Neukölln, is at the centre of the antisemitism dispute that nearly stopped the talks.Confirmed2311262728
- Behind all of them stands the 2021 referendum. It gave socialisation a democratic mandate, but not a law.
What is confirmed
- The election result and seat count are official. Left, Greens and SPD have a comfortable majority of 91 seats out of 153.Confirmed1021511
- The exploratory paper is public. It backs socialisation under Article 15 for private companies with 10,000 or more Berlin flats, lets each keep 10,000, exempts cooperatives, public-interest landlords and newer homes, and rules out Article 14 expropriation.Confirmed45367
- The paper sets a slow timetable: financing concept in 2027, bill in mid-2028, transfer one year after promulgation. Compensation is capped at 16 billion euros, if the budget can carry it.Confirmed4632
- It also promises that average starting rents in socialised flats will not rise above the old owner's level, plus a 2 percent cap at state-owned landlords, a rent watchdog and 100,000 building permits by 2031.Confirmed4711
- SPD and Greens have formally approved coalition talks. The Left has not yet voted.Confirmed189
- The legal ground is untested. Article 15 has never been used, a 2023 commission majority found it workable, and a 2026 framework law adds its own rules, including market value as the starting point for compensation.Confirmed131415162019
- Berlin's budget is tight: the city faces a gap of about 5 billion euros.Confirmed4311
What is still unconfirmed
- The 160,000 figure and the list of five companies. They come from Eralp, and no official count by company has been published.Unconfirmed211
- Whether the plan is unconstitutional. Vonovia says yes, the commission majority said socialisation can work, and only a court can settle it.Unconfirmed2316
- Whether 16 billion euros is enough. The landlords' association BBU calls it far too low, the 2021 official estimate for the larger version was 28.8 to 36 billion euros, and no new estimate exists.Unconfirmed614
- Whether a federal law can stop the plan. Berlin's federal partners want one, but no bill exists and scholars doubt it would hold.Unconfirmed222
- Whether SPD and Greens had a deal to keep Emde out of the Left group, and whether she will now be expelled.Unconfirmed2423282627
No evidence found
- Claim: the 16 billion euros are already financed. No evidence found. The financing concept is due only in 2027.No evidence found411
- Claim: rents in socialised flats will fall. No evidence found. The paper promises that average starting rents will not rise above the old level, not that they will drop.No evidence found4
- Claim: landlords have already sued. No evidence found. There is no law yet to sue against. No evidence found123
- These claims mix up a plan with its results. The paper promises a process, not money in the bank or lower rents.
What is false
- Claim: Berlin has decided to expropriate its big landlords. False. It is a plan from exploratory talks, with a law scheduled for mid-2028.FalseConfirmed1234689
- Claim: homeowners and small landlords will lose their flats. False. Only companies with 10,000 or more flats are covered, and they keep 10,000.FalseConfirmed467
- Claim: Eralp already governs Berlin. False. Coalition talks have not even started.False29930
What this means
- Two things are easy to mix up. One is that Berlin's likely new majority wants to socialise large housing companies; that is real and written down. The other is that it has already happened or been decided; that is false.
- For tenants of Vonovia and the other big firms, nothing changes now. Even on the parties' own timetable, the first transfer would come in 2029 at the earliest, and the promise is stable average rents, not lower ones.ConfirmedNo evidence found463
- For investors and the city budget, the open question is money. The cap is 16 billion euros, the city is short about 5 billion, and the 2026 framework law points to market value as the starting point.Confirmed4623112019
- For the courts, this would be a first. Article 15 has never been applied, and Berlin's last big housing law, the rent cap, was struck down after it had already taken effect.Confirmed13141517
- As of 20 October 2026 evening KST, the plan stands and the law does not. That is why the verdict calls the premise false.
Open questions
- Will the Left party conference on 31 October approve coalition talks, and will the Emde dispute weigh on that vote?
- What will the 2027 financing concept say, and can compensation stay at 16 billion euros if the framework law starts from market value?
- Will the coalition ask the Constitutional Court to review the law before any flats change hands, as the outgoing Senate planned for its framework law?
- How many flats, and which companies, will the bill actually name?
- Will the federal coalition actually table its announced ban on state socialisation, and would it survive in Karlsruhe?
